Service Terms for Mould & Damp Consultancy
These terms and conditions govern the provision of mould and damp survey services by Mouldsurv Ltd. By engaging our services, you agree to be bound by these terms.
1. Definitions
"Company", "We", "Our" refers to Mouldsurv Ltd, a company registered in England and Wales.
"Client", "You", "Your" refers to the person or organization engaging our services.
"Services" refers to mould inspections, damp surveys, air quality testing, remediation, and related consultancy services.
"Report" refers to written survey findings and recommendations provided by the Company.
2. Service Provision
2.1 Scope of Services
We will provide mould and damp survey services in accordance with current industry standards, HHSRS guidance, and UK housing legislation. Services are subject to site access and safety considerations.
2.2 Professional Standards
All surveys are conducted by qualified surveyors using calibrated equipment. We maintain ISO 9001:2015 certification and adhere to relevant health and safety legislation.
2.3 Report Delivery
Survey reports will typically be delivered within 24-48 hours of site visit completion. Reports remain the property of the Client upon full payment.
3. Payment Terms
3.1 Pricing
Quotations are valid for 30 days and based on information provided at time of enquiry. Final pricing may be adjusted if site conditions differ materially from those described.
3.2 Payment Due
Payment is due upon completion of services unless otherwise agreed in writing. For commercial clients, we offer 30-day payment terms subject to credit approval.
3.3 Late Payment
Late payment may incur interest charges at a rate of 8% per annum above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
4. Liability and Indemnity
4.1 Professional Indemnity
We maintain professional indemnity insurance covering our services. Our liability is limited to the value of professional indemnity insurance cover available at the time of any claim.
4.2 Exclusions
We are not liable for pre-existing conditions not reasonably detectable during the survey, or for consequential losses arising from third-party actions based on our reports.
4.3 Report Use
Reports are prepared for the named Client only and should not be relied upon by third parties without our written consent. We accept no liability for third-party reliance.
5. Client Responsibilities
- Provide safe and unobstructed access to all areas requiring inspection
- Inform us of any known hazards or access restrictions prior to site visit
- Ensure building occupants are notified of survey activities where appropriate
- Provide accurate property information including size, age, and construction type
- Arrange utility isolation where required for intrusive inspections
6. Cancellation and Rescheduling
Appointments may be cancelled or rescheduled without charge if notice is given at least 24 hours prior to the scheduled site visit.
Cancellations with less than 24 hours notice may incur a cancellation fee of up to 50% of the quoted price. No-show appointments will be charged at the full quoted rate.
7. Intellectual Property
All reports, methodologies, and materials produced remain the intellectual property of Mouldsurv Ltd. The Client receives a license to use the report for its intended purpose only.
Reproduction or distribution of reports to third parties requires our prior written consent.
8. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
